29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:  (a) On or about October 30, 2013 at the jobsite located at or near the intersection of Highway 45 and Crooked Road, near The Greens at Crooked Road, in Parkville MO, employees were exposed to water accumulated in the bottom of the trench approximately 15 feet deep.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  (a) On or about October 30, 2013 at the jobsite located at or near the intersection of Highway 45 and Crooked Road, near The Greens at Crooked Road, in Parkville MO, employees were exposed to an engulfment hazard in that the excavation was not inspected by a competent person for water accumulation and no protective shoring systems in use.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the employer had not met all elements of sloping/benching:   (a) On October 30, 2013, at the jobsite at or near the intersection of Highway 45 and Crooked Road, near The Greens at Crooked Road, in Parkville, MO, employees were exposed to a cave- in hazard while working in an excavated trench at a depth of appproximately 15 feet without proper shoring, benching, or sloping.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) On or about October 30, 2013, at the jobsite located at or near the intersection of Highway 45 and Crooked Road, near The Greens at Crooked Road, in Parkville MO, employees were exposed to a fall hazard in that the ladder did not extend at least 3 feet above the edge of the excavation.
