29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person prior to the start of work, and as needed throughout the shift, for evidence of situations that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. a- 2865 Brunswick Pike, Lawrenceville NJ: On or about 10/30/13, as a result of no daily inspections of the worksite excavation being performed by a competent person, a company employee was exposed to cave in and crushing hazards when working in a trench (approximately 7 feet 2 inches deep at point of exposure) that contained sidewalls that were not sloped, benched, shored, or shielded to protect them. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
