29 CFR 1910.179(f)(6)(iii): On all floor, remote and pulpit-operated crane bridge drives, a brake of noncoasting mechanical drive shall be provided. a. At the site located in Heath, Ohio the employer had a Northern 10 ton (#27) overhead crane that was not equipped with functioning brakes. On or about October 18, 2013 an employee was struck by a stack of aluminum that was being loaded onto a flatbed trailer with crane #27.

29 CFR 1910.179(l)(3)(i): Any unsafe conditions disclosed by the inspection requirements of paragraph (j) of this section shall be corrected before operation of the crane is resumed. Adjustments and repairs shall be done only by designated personnel. a. At the site located in Heath, Ohio the employer had periodic inspections performed on a 10 ton overhead crane (#27) which which documented safety deficiencies, but the employer never took steps to correct the deficiencies before normal use resumed. Hazards documented on the periodic inspection included, but were not limited to non-functioning brakes, non-functioning horn, and missing safety latch on the hook.
