29 CFR 1910.266(e)(1)(ii)(E): The employer did not assure that each tool, including any tool provided by an employee, was inspected before initial use during each work shift to ensure that the chain brake was in place and functioning properly: Warm Springs Metolius Timber Sale, Block 60 (Landing)- (a) The knot bumper was observed cleaning-up knots and limbs from logs using a Husqvarna chain saw, which had a non-functional chain brake, exposing the operator to severe lacerations.

29 CFR 1910.266(d)(1)(vi): The employer did not assure that each employee who worked in an area where there was potential for head injury from falling or flying objects wore head protection meeting the requirements of subpart I of Part 1910: Warm Springs Metolius Timber Sale, Block 60 (Landing)- (a) The chain saw operator (knot bumper) was observed working on the landing cleaning-up knots and limbs of logs located on the landing. The operator was not wearing head protection to protect against struck-by injuries caused by the unintended movement of the chain saw or flying objects while cutting.
