29 CFR 1926.451(b)(1):  Each platform on all working levels of scaffolds were not fully planked or decked between the front uprights and the guardrail supports:    (a)Rogelio Montanez at 4635 Vinewood Way, Johnstown, CO 80534:  On October 31, 2013 the employer did not ensure the working platform on the fabricated frame scaffold was fully planked in that the scaffold was 13 feet high and extended approximately 5 feet over the roof and had 2, 10 inch planks as a working surface.  This condition exposed the employee to a fall hazard of up to approximately 13 feet.

29 CFR 1926.451(g)(1):  Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level.    (a)Rogelio Montanez at 4635 Vinewood Way, Johnstown, CO 80534: On October 31, 2013 the employer did not ensure the employees working from a fabricated frame scaffold were protected from falling by adequate fall protective measures in that no guard rails were installed on the scaffold.  This condition exposed employee to a fall hazard of 13 feet.

(a)Rogelio Montanez at 4635 Vinewood Way, Johnstown, CO 80534: On October 31, 2013 the employer did not ensure the fabricated frame scaffold was plumb. This condition exposed employees to the hazard of scaffold shifting and/or collapse and exposed the employee to a fall hazard of approximately 13 feet.

29 CFR 1926.451(e)(1):  Scaffold platforms that were more than two feet (0.6m) above or below a point of access were not provided with a means of access:   (a)Rogelio Montanez at 4635 Vinewood Way, Johnstown, CO 80534: On October 31, 2013 the employee did not ensure a ladder was provided to allow for safe access and egress to the fabricated frame scaffold.  Without the ladder the employees climbed the bracing.  This condition exposed the employees to a fall hazard of approximately 13 feet.

29 CFR 1926.451(f)(3):  Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:   (a)Rogelio Montanez at 4635 Vinewood Way, Johnstown, CO 80534: On October 31, 2013 the employer did not ensure the fabricated frame scaffold had been inspected for visible defects by a competent person before use.  Without the inspections employees were exposed to scaffold fall hazards of approximately 13 feet.     Abatement Note:  Concerning the requirements and duties of a competent person:    (1)  "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.    (2)  The competent person must be able to carry out the tasks specified in the standard. In order to be able to carry out the tasks the competent person needs to have knowledge in the issues relating to the strength and structural integrity of the scaffold. A competent person must be fully knowledgeable about erecting, disassembling, moving, operating, repairing, maintaining and inspecting the scaffold.    (3)  Section 1926.454 states that a competent person will train employees involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold. To meet this requirement, a competent person must be fully knowledgeable about erecting, disassembling, moving, operating, repairing, maintaining and inspecting  the scaffold.
