29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:  On or about November 1, 2013, at 126 Churchill Rd, Boerne,TX , employee(s) were framing the second floor.  The wall openings on the second floor were not guarded to prevent employees from falling. Employee(s) exposed to a thirteen feet fall.   In the alternative: 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  On or about November 1, 2013, at 126 Churchill Rd, Boerne, TX , employee(s) were exposed falling up to ten feet while accessing a ladder. Employees were descending down through the rafters to the top step of the ladder that was five feet tall.  Employee(s) were observed stepping on the top rung of the step ladder. The Werner step ladder was used in a manner that is prohibited by the manufacturer.
