29 CFR 1926.451(b)(2)(i):   Each ladder jack scaffold, top plate bracket scaffold, roof bracket scaffold, and pump jack scaffold was not at least 12 inches (30 cm) wide:  a)  Worksite, 3813 Niami St., Seaford, east side of residence - Two employees were installing siding while working from the platform of a pump jack scaffold that had a single 2" x 6" inch plank, approximately 12 feet above the ground below; on or about 10/30/13.   Note:  Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.451(f)(7):   Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration; Such activities were not performed only by experienced and trained employees selected for such work by the competent person:  a) Worksite, 3813 Niami St., Seaford, NY, east side of residence- Two employees were installing siding and capping to a two story residential home from the platform of a pump jack scaffold with one 2" x 6" plank as a platform, and no guardrails; on or about 01/07/13.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a)  Worksite, 3813 Niami St., Seaford, east side of residence - Employees were working from the platform of a pump jack scaffold approximately 12 feet above the ground below with no Personal Fall Arrest System or guardrails; on or about 10/30/13.  Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
