29 CFR 1926.652(c)(4): Designs of support systems, shield systems, and other protective systems selected and constructed by the employer or his designee were not in accordance with the requirements of paragraph (c)(1); or, in the alternative, paragraph (c)(2); or, in the alternative, paragraph (c)(3); or, in the alternative, paragraph (c)(4) and were not approved by a registered professional engineer: At this excavation site, employees worked in an excavation approximately 8 feet deep by 12 feet wide by 40 feet in length in which the employer had installed a protective system not designed and approved by a registered professional engineer: A. Road plates had been installed to protect the east and west lateral walls of the excavation. B. Plywood sheeting braced by timber shoring driven into the ground had been installed above the existing force main pipe on the north and south sides of the force main. C. A timber shoring plank had been installed at the north end of the force main to prevent collapse of the road plates.
