29 CFR 1926.502(d)(6)(i): A snap hook not of the design type was engaged directly to webbing, rope or wire rope;  a) Residential jobsite: On November 4, 2013 and at times prior thereto employees engaged in roofing activities did not properly install/use the fall protection system that was in place.  Employees attached the rope lanyard with a knot to the snap hook on the shock absorbing lanyard.    Note) Abatement certification IS required for this item.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  a) Residential jobsite: On November 4, 2013 and at times prior thereto employees engaged in roofing activities did not recognize or acknowledge the hazard of not properly wearing a fall protection harness, and take appropriate actions to correct the hazard.   b) Residential jobsite: On November 4, 2013 and at times prior thereto employees engaged in roofing activities did not recognize or acknowledge the hazard of not attaching the fall protection harness to a lanyard/anchor point, and take appropriate actions to correct the hazard.  c) Residential jobsite: On November 4, 2013 and at times prior thereto employees engaged in roofing activities did not recognize or acknowledge the hazard of using a fall protection system that did not have all the proper components in place, and take appropriate actions to correct the hazard.  Note) Abatement certification IS required for this item.

29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Residential jobsite: On November 4, 2013 and at times prior thereto employees did not wear hardhats while performing clean-up activities on the ground in areas where roofing activities were being performed overhead.    Gabriel Lopez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a), which was contained in OSHA inspection number 108277, citation number 2, item number 1, and was affirmed as a final order on May 6, 2013, with respect to a workplace located at 6125 West Bradley Ave, Milwaukee, WI 53223.    Gabriel Lopez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a), which was contained in OSHA inspection number 313720112, citation number 1, item number 1, and was affirmed as a final order on August 17, 2010, with respect to a workplace located at 6670 Lonewood, Colorado Springs, CO 80925.   Note) Abatement certification and documentation ARE required for this item.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system:  a)  Residential jobsite: On November 4, 2013 and at times prior thereto employees performing roofing work on a 7 in 12 pitched roof where exposed to a fall hazard when they did not properly utilize the fall protection system that was in place.  The leg straps on the employees harnesses were not fastened and the harnesses were not attached to the lanyards/anchor points.    Gabriel Lopez Alvarez dba Three Amigos was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA inspection number 108277, citation number 2, item number 2 and was affirmed as a final order on May 6, 2013, with respect to a workplace location at 6125 West Bradley Ave, Milwaukee, WI 53223.
