29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2):  (a)  Riestras Kitchen & Bath, 3331 W. 71st Ave., Westminster, CO 80030:   (a)   On and before 4/6/12, the employer did not ensure through written verification that a workplace personal protective equipment (PPE) hazard assessment had been performed.  Employees conducted hazardous operations which include exposure to respirable crystalline silica and chemicals.   Abatement note: The employer shall verify that the required workplace hazard assessment has been performed through a written certification that shall include the following:          (1) Identifies the workplace evaluated;       (2) The person certifying that the evaluation has been performed;       (3) The date(s) that the hazard assessment was performed; and       (4) Which identifies the document as a certification of hazard assessment.

29 CFR 1910.243(c)(3): Vertical portable grinders. Safety guards used on machines known as right angle head or vertical portable grinders shall have a maximum exposure angle of 180 deg., and the guard shall be so located so as to be between the operator and the wheel during use. Adjustment of guard shall be such that pieces of an accidentally broken wheel will be deflected away from the operator.   (a)  Riestras Kitchen & Bath, 3331 W. 71st Ave., Westminster, CO 80030:  On and before 11/4/13 the employer did not ensure that an abrasive wheel on a right angle grinder was used with a guard.  It was observed that the Makitta grinder and or cutting tool (serial# 201712A) had been used to conduct stone fabrication operations without the abrasive wheel guard.  This condition exposed the employee to a projectile hazard.

29 CFR 1910.305(d)(2):  Panelboards other than the dead front externally-operable type were accessible to unqualified persons:   (a)  Riestras Kitchen & Bath, 3331 W. 71st Ave., Westminster, CO 80030:  On and before 11/4/14,  the electrical panel located on the North wall was missing multiple dead fronts exposing energized bus bars.  This panel is accessed daily to turn on lights and power tools.  This exposed employees to an electrical shock hazard.

29 CFR 1910.303(f)(2): Each service, feeder, and branch circuit, at its disconnecting means or overcurrent device, was not legibly marked to indicate its purpose, and was not located and arranged so the purpose was evident:  (a)  Riestras Kitchen & Bath, 3331 W. 71st Ave., Westminster, CO 80030:  On and before 11/4/13,  the employer did not ensure each circuit breaker was legibly marked to indicate its purpose in the electrical panel box located on the east side of the interior wall between the vegetative and flower areas.  This condition exposed the employees to electrical shock hazards.

29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   (a)  Riestras Kitchen & Bath, 3331 W. 71st Ave., Westminster, CO 80030:  On and before 11/4/13, the employer did not develop, implement, and maintain at the workplace a site specific written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  The employer utilizes products such as, but not limited to adhesives, solvents and paint thinner.     Abatement note:  The written hazard communication program will also include:    (1) A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate material safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,    (2) The methods the employer will use to inform employees of the hazards of non-routine tasks.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.  (a)  Riestras Kitchen & Bath 3331 W. 71st Ave., Westminster, CO 80030:  On and before 11/4/13, the employer did not ensure that employees were provided effective information and training as specified in 29 CFR 1910.1200(h) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area.  Employees worked with chemicals such as, but not limited to adhesives, solvents and paint thinner during cleaning and fabricating granite.  The employer had not provided hazard communication training for chemical use and silica dust.

29 CFR 1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard");  (a)   Riestras Kitchen & Bath 3331 W. 71st Ave., Westminster, CO 80030:  On and before 11/4/13 the employer did not provide respirator users with the information contained in Appendix D to 29 CFR 1910.134.  Employees are permitted to wear 3M half-mask elastomeric respirators while conducting stone slab fabrication operations.  This condition exposes employees to the hazard of not understanding the proper use and limitations of their respirator.
