29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired: At this excavation project a portable ladder with the following structural defects was used to ingress and egress from anexcavation: A. The footings are the bottom of the ladder were bent out of the intended position. B. The device for allowing the sliding up and down of the extension part of the ladder was broken; wire was used to secure the ratchet device in place.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation walls were not in accordance with Appendix B of this part: At this excavation project employees worked in a trench greater than 8 foot deep without a protective system. The south wall of the trench was nearly vertical and the north side of the trench was not sloped or benched in accordance with Appendix B of this part. Sendero Industries, L.LC., was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 315367805, citation number 01, item number 05, and was affirmed as a final order on August 26, 2011, with respect to a workplace located at 206 Milanos, Weslaco, TX 78596.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety. At this excavation project the designated competent person did not remove employees working in a trench greater than 5 feet deep while the employees worked without a protective system or method. Sendero Industries, L.L.C. was previously cited for a violation of this occupational safety and health standard , which was contained in OSHA inspection number315367805, citation number 01, item number 04, August 26, 2011 and was affirmed as a final order on August 26, 2011, with respect to a workplace located at206 Milanos, Weslaco, TX 78596.
