29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety: (a) On or about November 6, 2013, for the employees exposed to cave-in hazards while conducting sewer and water line connections in a trench approximately twelve feet deep with an unprotected vertical wall that was identified by the competent person at or near the intersection of South Washington and South Victory Circle, Bismarck, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 108453, Citation Number 1, Item Number 1A, and was affirmed as a final order on April 2, 2012, with respect to a workplace located at the corner of Highway 83 and County Road 36, Wilton, North Dakota.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On or about November 6, 2013, for the employees exposed to cave-in hazards while conducting sewer and water line connections in a trench approximately twelve feet deep with an unprotected vertical wall at or near the intersection of South Washington and South Victory Circle, Bismarck, North Dakota.
