29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.  a) On or about 11/06/13, on roof of residential jobsite located at 190 Hoyt St., Buffalo, NY: Employees operating or working in areas where Pneumatic Nail Guns were being used were not wearing safety glasses and hardhats.  b) On or about 11/06/13, on residential jobsite located at 190 Hoyt St., Buffalo, NY: Employees cleaning up old roofing materials on the ground were exposed to getting struck in the eyes/head by roofing material being dropped/thrown from the roof to the ground approx. 22 ft. above them. The employees were not wearing safety glasses and hardhats.   ABATEMENT CERTIFICATION REQUIRED

The siderails of the ladder extended approx. 18 inches above the "pic".       NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used:     a) On or about 11/06/13, on residential jobsite located at 190 Hoyt St., Buffalo, NY: Employees were exposed to a fall of approx. 22 ft. to the ground while hoisting themselves up a distance of approx. 3 ft. from the narrow aluminum "pic" of the ladder jack scaffold to the roof. Direct access to the roof was not provided.    NO ABATEMENT CERTIFICATION REQUIRED
