29 CFR 1926.106(a): Employees working over or near water, where the danger of drowning exists, were not provided with U.S. Coast Guard-approved life jacket or buoyant work vests:       a) Job site, 1 Herron Way, Pittsburgh, PA: On or about November 7, 2013, during slip seal installation activities on a concrete bridge deck, the employer did not ensure that employees were utilizing life vests where inappopriate fall protection systems/devices were in use. A metal railing was used as fall protection and was measured to be approximately 34 1/2" in height, exposing employees to fall hazards into a swollen creek below.

29 CFR 1926.502(b)(1): The top edge height of top rails, or equivalent guardrail system members, were not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level:       a) Job site, 1 Herron Way, Pittsburgh, PA: On or about November 7, 2013, during slip seal installation activities on a concrete bridge deck, the employer did not ensure that railing used as fall protection was of an appropriate height in that it was determined to be approximately 34 1/2" in height, exposing employees to fall hazards of up to approximately 15 feet.
