29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: On or about November 7, 2013, employees performing framing work were not protected by a protective helmet while working underneath employees that were cleaning above at higher levels. The employees were exposed to being struck by objects and/or debris falling from a height greater than (12) feet.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. On or about November 7, 2013, an employee was cleaning and loading a material handler near a wall opening located on the 2nd floor of a construction project was not protected from falling. The employee was exposed to fall hazards of 6 feet or more above lower levels to the ground below.
