29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) Jobsite located at 2 W. Farragut Avenue, Long Beach Island NJ: Company employees from Colmyer & Son Construction were exposed to fall hazards of approximately 14 feet to the ground below without using fall protection or guard rails while installing the deck on the second level of a residence under construction. Occurred on or about 11/06/2013.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards. a) Jobsite located at 2 W. Farragut Avenue, Long Beach Island NJ: Company employees from Colmyer & Son Construction were exposed to fall hazards of approximately 14 feet to the ground below without using fall protection or guard rails while installing the deck on the second level of a residence under construction. The employees did not have fall protection training. Occurred on or about 11/06/2013.
