29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: a) For the SOHO Apartment Complex jobsite at the intersection of Howard Ave. and Swann Ave. in Tampa, FL, as occurring between 08/23/2013 and 11/6/2013, a functioning safety program with frequent site inspections of jobsite materials and equipment was not present for LG Carpentry. Ladders used were damaged, 12 separate instances of fall hazards for LG Carpentry employees were documented by the general contractor for the jobsite, and safety inspections of the jobsite activity were not conducted regularly/daily by LG Carpentry. On 11/6/2013, an employee of LG Carpentry fell over 25 ft. from a third story balcony sustaining injuries and was hospitalized.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii): a) For the SOHO Apartment Complex jobsite at the intersection of Howard Ave. and Swann Ave. in Tampa, FL, as occurring on or about 11/06/2013: employees interviewed were not adequately trained on the safe use of fall protection equipment, and stated that multiple people would often tie off to the same anchor point as a normal practice. Anchor points used on site were designed for one person only, and the person giving employees fall protection training, himself, was not aware of the load that the anchor points were designed to hold.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards. a) For the SOHO Apartment Complex jobsite at the intersection of Howard Ave. and Swann Ave. in Tampa, FL, as occurring on or about 11/06/2013: employees were not trained to recognize ladder hazards. Employees used step ladders that were visibly damaged, in that, the area where the bolt connected to the spreader had worn into a larger hole on the frame of the ladder resulting in the movement/wobble of the spreader and ladder. Employees stated that they had inspected the ladders and thought they were fine.

Employees were in the process of constructing balconies and exposed to falls from the ladders to the surface below.
