OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to the hazard of being struck by a Hamilton cement form. On or about November 7, 2013, a Hamilton form with wheel carriages did not remain in an upright position.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition. On or about November 7, 2013, at the site, the employer failed to ensure that the area between the cement form lines I and J were free from scrap steel, cabling and other debris on the ground to the extent the work allowed. Employee(s) exposed to tripping hazards while walking in-between and pushing in the cement forms.
