29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a.   A Glass Handler, cutting, moving and seaming glass, was exposed to a noise dose of 173.3%, or an equivalent dBA (decibels A scale) of 93.97 dBA, which is capable of causing permanent hearing loss. The noise sampling was conducted for 305 minutes during one work shift on November 13, 2013.      b.   A Glass Handler, cutting, moving and seaming glass, was exposed to a noise dose of 177.9%, or an equivalent dBA of 94.16 dBA, which is capable of causing permanent hearing loss. The noise sample was conducted for 314 minutes during one work shift on November 13, 2013.         c.   A Glass Handler, cutting, moving and seaming glass, was exposed to a noise dose of 120.3%, or an equivalent dBA of 90.16 dBA, which is capable of causing permanent hearing loss. The noise sample was conducted for 339 minutes during one work shift on November 13, 2013.      On or about November 13, 2013, the employer did not provide an effective hearing conservation program, in that all employees were not provided a baseline audiogram within 6 months of their first exposure, and all employees were not provided audiograms annually after the obtaining of their baseline audiogram.
