29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a- 614 East Long Branch, Ocean Gate NJ: On or about 11/08/13, company employees performing wall framing and other related activities from the unprotected edges of a residential structure's second floor were exposed to falls of approximately 20 feet 1 inch to the ground below when they were not provided with any fall protection. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): A training program was not provided to each employee who might be exposed to fall hazards, to enable that employee to recognize the hazards of falling, and be trained in the procedures to be followed to minimize these hazards: a- 614 East Long Branch, Ocean Gate NJ: On or about 11/08/13, company employees performing wall framing and other related activities from the unprotected edges of a residential structure's second floor were exposed to falls of approximately 20 feet 1 inch to the ground below when they were not provided with any fall protection. In addition, the company employees had not received fall protection training. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a- 614 East Long Branch, Ocean Gate NJ: On or about 11/08/13, company employees used a portable extension ladder to access/egress the structure's second floor. This ladder's side rails extended above the landing surface not greater than 12 inches. As such employees were exposed to falls of approximately 20 feet 1 inch to the ground below.
