29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied. On and before November 8, 2013 at the worksite, the general contractor allowed a subcontractor to work from a ladder jack scaffold plank, which was resting on the forks of an all-terrain PIV and secured on one side by a lifting strap, at a height of approximately 14 ft.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On and before November 8, 2013 at the worksite, the general contractor allowed a subcontractor to work from a ladder jack scaffold plank, which was resting on the forks of an all-terrain PIV, at a height of approximately 14 ft. without being protected by any type of guardrail system of PFAS.
