29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95 (c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) Blacksmith Area: On or about November 5, 2013, an employee pounding and shaping carbon steel was exposed to continuous noise levels in excess of the allowable 8-hour Time Weighted Average (TWA) sound level of 85 dbA. The employer did not implement an effective hearing conservation program in that baseline / annual audiometric testing was not conducted. Noise sampling performed for 438 minutes indicated exposure to a 151.4% noise dose which is equivalent to approximately 92.9 dbA. Zero exposure was assumed for the 42 minutes not sampled. (b) Blacksmith Area: On or about November 5, 2013, an employee doing welding and layout work was exposed to continuous noise levels in excess of the allowable 8-hour Time Weighted Average (TWA) sound level of 85 dbA. The employer did not implement an effective hearing conservation program in that baseline / annual audiometric testing was not conducted. Noise sampling performed for 425 minutes indicated exposure to a 77.33% noise dose which is equivalent to approximately 88.1 dbA. Zero exposure was assumed for the 55 minutes not sampled.
