29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder.    On November 14, 2013, employees repairing and cleaning gutters from the canopy were exposed to a fall of seventeen (17) feet seven (7) inches, created by the presence of unprotected sides.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.67(c)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  On November 14, 2013 employees utilizing an aerial lift to access the canopy were not wearing a body belt or full body harness, thereby exposing the employees to a fall of seventeen (17) feet seven (7) inches.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
