29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c). The employer does not protect employees in excavations from cave-ins by an adequate protective system. This violation was observed on or about November 11, 2013, at the job site where an employee was exposed to a crushed-by hazard when working in an excavation without being protected by an adequate protective system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected cave-ins while working in excavations.
