29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary:  a. On or about November 13, 2013, the right side scaffold system was not fully planked on the first level and had gaps, exposing the employee to a 7.5 feet fall hazard. On or about November 13, 2013, both two buck high scaffold systems were erected in the dirt, exposing the employees to crushing hazards.  The legs and posts were not erected with mudsills or base plates.  Abatement Certification and Documentation are not required

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used:  a. On or about November 13, 2013, right side of the home, the two buck high scaffold system did not have a ladder.  The employee climbed the rungs, exposing himself to a 7.5 feet fall hazard.  b. On or about November 13, 2013, left side of the home, the two buck high scaffold system did not have a ladder.  The employee climbed the rungs, exposing himself to a 9.5 feet fall hazard.   Abatement Certification and Documentation are not required

On or about November 13, 2013, roof area, the employee standing on the roof plastering the exterior of a two-story home was not protected from falling 9.5 feet by the use of a guardrail system, safety net system or a personal fall arrest system.
