29 CFR 1910.1200(e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:   On or about November 14, 2013, and times prior thereto,  the employer did not develop, implement, and maintain an adequate written hazard communication program that describes how criteria for labels and other forms of warning, material safety data sheets, and employee information and training will be met.  Employees weld and grind materials such as, but not limited to, mild steel and stainless steel containing materials such as, but not limited to, Aluminum at levels of 1.5% and Tungsten at levels of 1.8%.  Employees also use welding wire and electrodes that contain materials such as, but not limited to, Silicon Dioxide (quartz) at levels up to 1.5%, Manganese at levels of up to 3.5%, Chromium at levels of 19-25%, and Nickel at levels of 8-36%.  Employees were exposed to the hazards associated with inhalation of metal fumes and grinding dust.

29 CFR 1910.334(a)(2)(i): Portable cord and plug connected equipment and flexible cord sets (extension cords) were not visually inspected before use on any shift for external defects (such as loose parts, deformed and missing pins, or damage to outer jacket or insulation) and for evidence of possible internal damage (such as pinched or crushed outer jacket):  On or about November 14, 2013, flexible cord sets being used to power a hand held portable grinder were not visually inspected for damage before use.  Employees were exposed to the hazard of electric shock.
