29 CFR 1926.501(b)(7)(ii): Each employee at the edge of a well, pit, shaft, or similar excavation 6 feet (1.8 m) or more in depth was not protected from falling by guardrail systems, fences, barricades, or covers:          a) On or about November 8, 2013,  Reconstruction Experts, Inc., as the controlling and exposing employer, did not ensure that its employees and the employees of Chivas Contractors, a subcontractor, were protected from fall hazards by guardrail systems, fences, barricades or covers, while working at the edge of an 11.5 feet deep excavation.  A Reconstruction Experts, Inc. employee and a Chivas Contractors employee were exposed to fall hazards of 11.5 feet while standing at the edge of the excavation where they were manually hoisting the spoils from the excavation up to the surface using a container tied to a rope. 29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access:       a) On or about November 8, 2013, Reconstruction Experts, Inc., as the controlling and exposing employer, did not ensure that its employees and the employees of Chivas Contractors, a subcontractor, were protected from fall hazards while using a portable ladder that did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access. A Reconstruction Experts, Inc. employee and a Chivas Contractors employee were exposed to fall hazards of 11.5 feet while entering and exiting an excavation to locate and repair a damaged water line. 29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:       a) On or about November 8, 2013, Reconstruction Experts, Inc., as the controlling and exposing employer, did not ensure that its employees and the employees of Chivas Contractors, a subcontractor, were protected from cave-in hazards while working in an excavation without adequate protective systems.  A Reconstruction Experts, Inc. employee and a Chivas Contractor employee were exposed to cave-in hazards while locating and repairing a damaged water line in an excavation 5 feet in diameter and 11.5 feet deep.
