29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  (a) for the employee working at 6755 33rd Street East, Sarasota, FL 34243, as noted on or about 11/22/2013, and operating the Toyota forklift.  The employee had not been provided formal training on operation of the forklift which could result in injuries to the operator or others nearby.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  (a) for the owner of the company located at 6755 33rd Street East, Sarasota, FL 34243, doing business as Pallet Recall Inc, as noted on or about 11/22/2013.  The owner, who provides training to others, had not been evaluated in more than 30 years.
