29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: a) 61 Sparta Ave, Sparta, NJ. Employees were observed using nail guns without the use of their eye and face protection, thereby exposing the employees to a eye and face injury. Violation observed on or about 11/15/2013.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) 61 Sparta Ave, Sparta, NJ. Employee was observed walking/working at the edge without any means of fall protection being use, thereby exposing the employee to fall hazard approximately 12 feet to the ground below. Violation observed on or about 11/15/2013. b) Employee was observed standing on the inside frame of the roof without any means of fall protection being use, thereby exposing employee to an inside fall hazard approximately 9 feet to the floor below. Violation observed on or about 11/15/2013. ETM Enterprises, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 315438887, citation number 1, item number 1 and was affirmed as a final order on 04/12/2011, with respect to a workplace located at 72 Shadylawn Drive, Madison, NJ.
