OSH ACT of 1970 Section 5(a)(1):  Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the hazard of injury from roll over or being thrown out of a powered industrial truck:  a. A seat belt was not installed on the Nissan forklift; a retrofit was available from the manufacturer.  Abatement documentation is required for this violation.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:  a. All aspects of required training were not provided to powered industrial truck operators, such as, but not limited to, the need for wheel chocks when loading or unloading trailers.  (Note: see 1910.178(l)(3) and the manufacturer's operations manual for content of training requirements.)  Abatement documentation is required for this violation.
