29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about October 31, 2013, operators were not trained in the safe use of powered industrial trucks. A powered industrial fork truck was utlizied and driven by employees on the work site located on the corner of State Route 82 and Commons Blvd., Twinsburg, OH. NOTE: Training shall consist of a combination of formal instruction (e.g., lecture, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems; On or about October 31, 2013, employees were performing roofing activities on a roof having a slop of 6/12 without the use of fall protection. The height was measured as approximately 18-20 feet. This was located on site at the corner of State Route 82 and Commons Blvd., Twinsburg, OH.
