29 CFR 1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that was reasonably accessible in terms of time and distance to the worksite, which was available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, was not be available at the worksite to render first aid: At the project on or about November 18, 2013, and at times prior thereto, no one had first aid training and the nearest medical facility was more than four minutes away. Employees used heavy earth moving equipment on slopes at the project.

29 CFR 1926.150(a)(4): All firefighting equipment was not periodically inspected and maintained in operating condition. Defective equipment was not immediately replaced: At the project on or about November 18, 2013, and at times prior thereto, there was no monthly inspection of the fire extinguishers onsite. The tag on the extinguisher said it was last inspected in October 2013. Onsite, there were dry grass and shrubs. Potential ignition sources the excavator motor and cigarettes tossed from passing vehicles. There were no alternate means to fight fires onsite, such as, 55 gallon drums with water and pails or hoses connected to water sources.
