OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck by hazards from the improper use of an aerial lift: a) Work Site - on or about October 31, 2013, employees were lifting a light post while it was suspended from the work platform of a Versalift Model VST 3600-1 Truck Mounted Aerial Lift which was not rated for lifting slung loads. ABATEMENT NOTE: One feasible means of abatement is to employ the use of material handling equipment designed with the intent to hoist and place loads. This violation finds the aerial lift was employed in a manner not permitted by the Versalift Operator's Manual as the aerial lift was not rated for the lifting of overhanging loads. ANSI A92.5-1980, American National Standard for Boom-Supported Elevating Work Platform Section 13.2.
