29 CFR 1926.451(c)(1)(ii): Guys, ties, and/or braces were not installed  according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and repeated vertically at locations of horizontal members every 20 feet (56.1 m) or less thereafter for scaffolds 3 feet ((0.91 m) wide or less, and every 26 feet (7.9 m) or less therafter for scaffolds greater than 3 feet (0.91m) wide.  On or about 10/25/2013 at the 46 West Street Project, employees were using a tubular welded frame scaffolding system that was not tied or braced at the 4:1 height.

29 CFR 1926.451(e)(5)(i): Ramps and walkways 6 feet (1.8 m) or more above lower levels did not have guardrail systems that comply with subpart M of this part -- Fall Protection:  On or about 10/25/2013 at the 46 West Street Project, employees were exposed to 30 foot fall hazards while using a walkway to access the roof deck from the tubular welded frame scaffold and no fall protection system was in use.

On or about 10/25/2013 at the 46 West Street Project, the employer did not have a competent person supervise and provide direction on the installation and use of a tubular welded frame scaffold system.
