29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. On or about 11-19-2013, the employer failed to ensure that protective equipment was being used. A forklift driver was operating a forklift without wearing a seatbelt. The forklift was equipped with a seatbelt.

On or about 11-19-13, the employer failed to ensure that a forklift operators performance had been evaluated within the last 3 years.
