29 CFR 1926.754(e)(1)(v): At the end of the shift or when environmental or jobsite conditions require, metal decking was not secured against displacement.      a) F.X. Caprara New Dealership Project, Ford Building, Pulaski, NY - On or about 18 November, 2013 - Employees were working with metal decking on the roof working surface that was not secured against displacement when the environmental (wind gusts) conditions required it.    Or, in the alternative:  OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard.      a) F.X. Caprara New Dealership Project, Pulaski, NY - On or about 18 November, 2013  An employee was struck by displaced steel decking that was unsecured on a rough terrain forklift elevated to the roof level and subsequently blown off the roof.

29 CFR 1926.760(d)(1): Guardrail systems, safety net systems, personal fall arrest systems, positioning device systems and their components did not conform to the criteria in 29 CFR 1926.502 (see Appendix G to this subpart).    a) F.X. Caprara New Dealership Project, Ford Building, Pulaski, NY - On or about 6 November, 2013 - Employees were using personal fall arrest anchors that were not installed according to manufacturers requirement to ensure the anchor point was capable of supporting at least 5,000 lbs. per employee attached.

Caprara New Dealership Project, Ford Building, Pulaski, NY - On or about 18 November, 2013 - Employees were installing metal decking on the roof working surface where the employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.
