29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: (a) Harvest Construction @ 19125 CR 5, Berthoud, CO. On or before November 13, 2013, the exposing employer did not ensure that each employee conducting work in the pole barn under construction was provided hard hats. This condition exposed employees to a possible danger of head injury from impact, or from falling or flying objects from elevation, or from electrical shock and burns. On October 15, 2013 an employee while working under the barn roof, a piece of wood fell and hit him on the head resulting in a head laceration. He was not wearing a hard hat.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms when the entire platform was not attached to the fork or while the fork-lift was moved horizontally while the platform was occupied: (a) Harvest Construction @ 19125 CR 5, Berthoud, CO. On or before November 13, 2013, the exposing employer did not ensure that the personnel platform was securely attached to the forks of the SkyTrak-39985, Rough Terrain Fork-Lift, to prevent displacement or collapse while the platform was being occupied. This condition exposed employees to a fall hazard of approximately 11 feet to ground.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems (PFAS). On or before November 13, 2013, the exposing employer did not ensure that suitable fall protection systems were utilized to safeguard each employee from falling while performing work activities such as but, not limited to framing and decking the roof of the pole barn having unprotected side(s) and edge(s) 6 feet or more above a lower level. This condition exposed employees to the hazard of falling from elevation up to approximately 22 feet to the ground.

29 CFR 1926.503(a)(2)(viii): The employer did not assure that each employee had been trained by a competent person qualified in the standards contained in subpart M: (a) Harvest Construction @ 19125 CR 5, Berthoud, CO. On or before November 13, 2013, the exposing employer did not ensure fall protection safety training was provided for each employee performing work activities such as but, not limited to framing and decking the roof of the pole barn having unprotected side(s) and edge(s) 6 feet or more above a lower level. This condition exposed employees to the hazard of falling from elevation up to approximately 22 feet to the ground. Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: (1) The nature of fall hazards in the work area; (2) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (3) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; (4) The role of each employee in the safety monitoring system when this system is used; (5) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; (6) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and (7) The role of employees in fall protection plans; (8) The standards contained in this subpart.
