(subcontractor) and Sierra Construction (subcontractor) protected their employees from head injuries as they worked without head protection in areas where shingles and other roofing waste were being thrown from upper levels.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were other provisions of paragraph (b) of this section used to provide an alternative fall protection measure: a) On or about November 14, 2013, Darby Enterprises, Inc., as a controlling employer, did not ensure that Mundo Roofing, Inc. (subcontractor) and Sierra Construction (subcontractor) protected their employees from falls greater than 6 feet while performing roofing work without adequate fall protection measures in place. Darby Enterprises, Inc. was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) or its equivalent which was contained in OSHA inspection 312139348, Citation 1, Item 1, issued April 8, 2009, with respect to a workplace located at 19673 Pine Drive, Parker, CO 80134. This citation became final on April 21, 2009.
