29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job-sites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):       (a)Twin Peak Erectors Co. @ 1687 Broadway, Boulder, CO 80304: On and before November 16th, 2013, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees on-site were permitted to work in areas where fall hazards existed during decking operations. This condition exposed the employees to a fall hazard of approximately 33 feet up to 37 feet. On November 16th, 2013, an employee welding in close proximity to the perimeter's edge on the south end of the roof, fell approximately 33 feet and died as a result of his injuries.      Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.502(b)(1): The top rail was not 42 inches (1.1m) plus or minus 3 inches (8cm) above the walking/working level:    (a)Twin Peak Erectors Co. @ 1687 Broadway, Boulder, CO 80304: On and before November 16th, 2013, the employer did not ensure the top cable railing of the guardrail system was 42 inches (+/- 3 inches) from the walking/working surface, in that, throughout the 3rd level located on the north side of the commercial building under construction. The top cable guardrail measured approximately 36 inches. This condition exposed employees working on the second level to a fall hazard of approximately 23 feet.    Abatement Note:  1926.760(d)(3) prescribes that perimeter safety cables shall conform to the criteria in 1925.502.

29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members shall be installed between the top edge of the guardrail system and the walking/working surface when there is no wall or parapet wall at least 21 inches (53 cm) high.      (a)Twin Peak Erectors Co @ 2617 Broadway, Boulder, CO 80304:  On and before November 16th, 2013, the exposing employer did not ensure the midrail was installed midway between the top rail and the walking/working surface in that throughout the building the midrail was 14" and the toprail was 37" from the walking working surface. This condition exposed the employees to a fall from heights of up to approximately 23 feet from the third level.     Abatement Note:  1926.760(d)(3) prescribes that perimeter safety cables shall conform to the criteria in 1925.502.

29 CFR 1926.503(a)(2)(ii): The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;    (a)Twin Peak Erectors Co. @ 1687 Broadway, Boulder, CO 80304: On and before November 16th, 2103, the exposing employer did not ensure employees were trained to recognize the correct procedures associated with erecting and maintaining the utilization of specific personal fall arrest equipment. Employees were using flexible, elastomeric, energy absorbing 60-inch lanyards, which were capable of extending a total of 72 inches, to be used in conjunction with Protecta JRG AD216 Self-Retracting Lifelines (SRL). The Protecta JRG SRL was also equipped with a 24-inch energy absorbing pack. The manufacturer specifications state that the user is not to use a JRG AD216 SRL with another fall protection system. This condition exposed employees to a free fall ranging from 12 to 14 feet.    Abatement note: Among other methods some feasible and acceptable abatement methods to correct this hazard is to perform the following: 1. Employees should use the Protecta JRG SRL which would allow them to access the work without the aid of an additional personal fall arrest system attachment.

29 CFR 1926.502(d)(16):  Personal fall arrest systems, when stopping a fall, shall be rigged such that employees can neither free fall more than 6 feet, nor contact any lower level:    (a)Twin Peak Erectors Co. @ 1687 Broadway, Boulder, CO 80304:  On and before November 16th, 2013, the exposing employer did not ensure that the personal fall arrest systems used by two employees limited the fall distance to 6 feet, nor prevented contact with the lower level.  Two employees connected 6 foot lanyards to self retracting lifelines that had approximately 6 feet extended along the horizontal plane of the perimeters edge of the roof.  The condition resulted in employees exposed to fall hazards of greater than 6 feet, and with the potential of contacting the next floor 12 feet below.    Abatement Note:  1926.760(d)(1) prescribes that personal fall arrest systems and their components shall conform to the criteria in 1925.502.

29 CFR 1926.760(a)(1):  Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems:         (a)Twin Peak Erectors Co. @ 1687 Broadway, Boulder, CO 80304:  On and before November 16th, 2013, the exposing employer did not ensure that employees working on the roof of a commercial building under construction were protected from fall hazards. Employees were constructing the leading edge in the form of roof deck panel installation and conducting final deck attachments simultaneously without the use of an adequate fall protection system. The condition exposed employees to fall hazards. On November 16th, 2013, an employee welding in close proximity to the perimeter's edge on the south end of the roof, fell approximately 33 feet and died as a result of his injuries.

29 CFR 1926.761(b): The employer had not provided a fall hazard training program for employees engaged in steel erection activities:       (a)Twin Peak Erectors Co. @ 2617 Broadway, Boulder CO 80304:  On and before November 16th, 2013, the exposing employer did not ensure that employees engaged in decking attachment of steel erection were appropriately trained on fall hazard identification, recognition and methods to guard against falling. This condition exposed the employees to a fall hazard from 34 feet to 37 feet.       Abatement Note: The following provisions supplement the requirements of 29 CFR 1926.21 regarding the hazards addressed in this subpart.       (a)  Training personnel. Training required by this section shall be provided by a qualified person(s).       (b)  Fall hazard training. The employer shall provide a training program for all employees exposed to fall hazards. The program shall include training and instruction in the following areas:       1)      The recognition and identification of fall hazards in the work area;   2)      The use and operation of guardrail systems (including perimeter safety cable systems), personal fall arrest systems, positioning device systems, fall restraint systems, safety net systems, and other protection to be used;   3)      The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;   4)      The procedures to be followed to prevent falls to lower levels and through or into holes and openings in walking/working surfaces and walls; and   5)      The fall protection requirements of this subpart.       (c) A qualified person means one who, by possession of a recognized degree, certificate, or professional standing, or who by extensive knowledge, training, and experience, has successfully demonstrated the ability to solve or resolve problems relating to the subject matter, the work, or the project.
