29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.    (a) Barclay Glen Apartments at Cross Keys, Williamstown NJ, Building 1900, Backside: A ladder had not been provided for access to the scaffold. Planking protruded out from the scaffold preventing a clear climb, observed on or about 11/19/13.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

(a)  Barclay Glen Apartments at Cross Keys, Williamstown NJ, Building 1900, Backside: Employees were working from the side brackets of the scaffold without the use of  endrails, approximately 12 to 22 feet above grade, observed on or about 11/19/13.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(4)(xv): Crossbracing used in place of a midrail was unacceptable because the crossing point of two braces  is not between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform.  The endpoints at each upright were more than 48 inches (1.3 m) apart.    (a) Barclay Glen Apartments at Cross Keys, Williamstown NJ, Building 1900, Backside: When cross bracing was used as guardrails a mid-rail had not been provided, 12 to 22 feet above grade, observed on or about 11/19/13.
