29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets:  a)    1600 building - Employees without head protection were installing truss components while working from the sloped roof, on or about 11/19/13;  b)    1500 building - Employees without head protection were installing truss components while working from the sloped roof, on or about 12/13/13.   NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:  a)    1500 building - Employees without any eye protection used pneumatic nail guns to while attaching floor trusses, on or about 11/19/13;  b)    1500 building - Employees without any eye protection were using pneumatic nail guns while attaching roof trusses, on or about 12/13/13;  c)     1500 building - Employees without any eye protection used an electrical circular saw to trim 2x6s as needed, on or about 12/13/13.   NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)    1500 building - Employees working from the top of the 1st floor (approximate 11 foot fall to ground) for the two story building without any type of fall protection were installing floor trusses, on or about 11/19/13;  b)    1700 building - Employee working from the roof top (approximate 33 foot fall to ground) for the three story building without any type of fall protection was installing roof trusses, on or about 11/19/13.  c)     1500 building - Employees working from the 6/12 pitch roof (approximate 22 foot fall to ground) for the two story building without any type of fall protection were installing roof trusses, on or about 12/13/13.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)    1500 building - Employees working from the top of the 1st floor (approximate 11 foot fall to ground) for the two story building without any type of fall protection were installing floor trusses, on or about 11/19/13;  b)    1700 building - Employee working from the roof top (approximate 33 foot fall to ground) for the three story building without any type of fall protection was installing roof trusses, on or about 11/19/13.  c)     1500 building - Employees working from the 6/12 pitch roof (approximate 22 foot fall to ground) for the two story building without any type of fall protection were installing roof trusses, on or about 12/13/13.
