29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill: a) Biltmore Estates, Worksite. - On or about November 14, 2013, employees were conducting framing work, no less than 24 feet above a lower level, were not protected by guardrail systems, safety net system, or personal fall arrest system. b) Biltmore Estates, Worksite, On or about November, 14, 2013, employee were working within the framework of a residential home project with multiple window openings that were not protected by the equivalent of a standard guardrail.

29 CFR 1926.1060(b): The employer did not provide retraining as necessary so that each employee exposed to fall hazards maintained the understanding and knowledge acquired through initial training: a) 2nd and 3rd floor of a residential building - On or about November 14, 2013, employees were conducting framing work while using a ladder which did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.
