29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii) On or about November 21 2013, the employer failed to ensure that the scaffold that was being used on site was fully planked on all the working platforms. The scaffold had two platforms that were being used and each platform was equiped with just one plank across the platform. Each platform needed approximatley 2 more planks to be fully planked. The bottom platform was approximatley 6 feet high while the top platform was approximatley 12 feet high.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about November 21 2013, the employer failed to ensure that the employees were provided with an adequate means of access both on and off the scaffold. The employees were seen climbing the frame of the scaffold to access and exit working platforms of the scaffold.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above the lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about November 21, 2013 the employer failed to ensure that employees working on the top platform of the scaffold had adequate fall protection. The top platform of the scaffold was approximatley 12 feet high and had no guardrail system. The employee seen working on the top platform also did not have on fall protection.
