29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   Establishment:   Employer had not developed and implemented a Hearing Conservation Program in accordance with this section that included elements such as baseline and/or annual audiograms for employees who engage in sheet metal fabrication.   An employee who was engaging in sheet metal work was exposed to a noise level at 140.1% dose of the permissible 8-hour time weighted average sound pressure level of 85 decibels (dBA).  The equivalent dBA of 140.1% dose is approximately 92.4 dBA.  The sampling was performed on November 21, 2013, for 252 minutes.  Zero exposure was assumed for time not sampled.
