29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): (a) On November 19, 2013, at the facility located at 1302 So 59th St., St. Joseph, MO., the employer did not ensure that all Powered Industrial Trucks use in the warehouse area were in a safe operating condition in the following instances: (1) 50 Nissan - Emergency Parking Brake not functional in Forward and Reverse gear operation. (2) Cat Forklift Model ET4000 - Emergency Parking Brake not functional in Forward gear operation. Abatement certification for this violation is not required.
