29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.           a) Rt 35 & Eisenhower Ave.:  The employer did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, Giaco Construction employees conducting siding activities from a pump jack scaffold were not using fall protection (guardrails, PFAS, etc.) and were thus exposed to a fall hazard of greater than 12 feet.  Observed on or about 11/18/2013.        NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    a) Rt 35 & Eisenhower Ave.:  The employer did not provide employees  working on scaffolds appropriate training.  As such, Giaco Construction employees conducting siding activities from a pump jack scaffold were not using fall protection (guardrails, PFAS, etc.) and were thus exposed to a fall hazard of greater than 12 feet.  Observed on or about 11/18/2013.        NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
