OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees On or about November 20, the employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. The employer did not ensure employees were wearing reflective / high visibility clothing when working outside of their truscks in and around other moving vehicles. Employees were exposed to struck by hazards. Among other methods, recognized and feasible means of abatement to correct this hazard is to ensure that employees are provided and wear suitable reflective / high visibility clothing at all times when walking / working outside of their trucks.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). Employee's engaged in trucking activities are exposed to struck-by hazards in that a job hazard assessment had not been completed to identify the need for personal protective equipment for employees who are engaged in hooking and/or unhooking trailers at the docking areas with high traffic volume.
