OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the failing of an automobile lift: a) Automotive Shop, far bay - The cable connecting the two safety latches on the Bend Pak, Inc. hydraulic automotive lift (10,000 pound capacity, model # MX-10AC, serial number 52066) was broken. On or about 12/2/13. FEASIBLE ABATEMENT METHOD: A feasible method of abatement would be to develop and implement a program to immediately repair any defects in the automotive lifts reported to them by the operators per ANSI/ALI ALOIM-2000 (Automotive Lift Institute) paragraph 6.2.1. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
