29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  (a) At the foundry: The employer did not evaluate the possible exposure to metals fumes like alumimum and brass.  On or about 12/03/2013, an employee melting and pouring yellow brass into the mold was exposed to an 8 hour time weighted average (TWA) level of 0.133 mg/m3 of Copper fumes, which is 1.33 times the OSHA permissible exposure level (PEL) of 0.1 mg/m3.

29 CFR 1910.134(a)(2): The employer did not establish and maintain a respiratory protection program which included the requirements outlined in 29 CFR 1910.134(c):   (a) At the foundry: The employer did not develop a written respiratory protection program for the exposed employees.  On or about 12/03/2013, an employee melting and pouring yellow brass into the mold was exposed to an 8 hour time weighted average (TWA) level of 0.133 mg/m3 of Copper fumes, which is 1.33 times the OSHA permissible exposure level (PEL) of 0.1 mg/m3.
