29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:  a.  At the work site, employees who painted and powder-coated commercial vehicle parts were required to use half-face respiratory protection.  The employer did not have a written respiratory protection program.

At the work site, portable fire extinguishers were located in several locations in the paint and powder coating booth areas where flammable materials were used and stored.  The employer had not ensured that three portable fire extinguishers were inspected monthly as required by the standard. The portable fire extinguishers were located by the large paint both, the small paint booth, and the overhead door leading to the paint area.

29 CFR 1910.1200(g)(1): Chemical manufacturers and importers shall obtain or develop a material safety data sheet for each hazardous chemical they produce or import. Employers shall have a material safety data sheet in the workplace for each hazardous chemical which they use.    a.  At the work site, employees in the paint department used various chemicals to paint, powder coat, and seal metal car parts. Employees also used chemicals to clean equipment and to adjust the paint mixtures for temperature and humidity fluctuations.  At the time of inspection, the employer did not have a safety data sheet (SDS) for each chemical in use at the work site which included, but was not limited to, Imron Elite, 15305S Activator, 681P34238 Primer and 36025S Thinner.

Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.    a.
